Critics Say They\u2019re Unconstitutional"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">As age-verification laws<\/span> continue to dismantle the adult industry\u2014and determine the <a href=\"https:\/\/www.wired.com\/story\/the-internet-revolutionized-porn-age-verification-could-upend-everything\/\" target=\"_blank\" rel=\"noopener\">future of free speech on the internet<\/a>\u2014a Utah lawmaker proposed a bill this week that would enforce a tax on <a href=\"https:\/\/www.wired.com\/tag\/porn\/\" target=\"_blank\" rel=\"noopener\">porn<\/a> sites that operate within the state.<\/p>\n<p class=\"paywall\">Introduced by state senator Calvin Musselman, a Republican, <a data-offer-url=\"https:\/\/le.utah.gov\/Session\/2026\/bills\/introduced\/SB0073.pdf\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/le.utah.gov\/Session\/2026\/bills\/introduced\/SB0073.pdf&quot;}\" href=\"https:\/\/le.utah.gov\/Session\/2026\/bills\/introduced\/SB0073.pdf\" rel=\"nofollow noopener\" target=\"_blank\">the bill<\/a> would impose a 7 percent tax on total receipts \u201cfrom sales, distributions, memberships, subscriptions, performances, and content amounting to material harmful to minors that is produced, sold, filmed, generated, or otherwise based\u201d in Utah. If passed, the bill would go into effect in May and would also require adult sites to pay a $500 annual fee to the State Tax Commission. Per the legislation, the money made from the tax will be used by Utah\u2019s Department of Health and Human Services to provide more mental health support for teens.<\/p>\n<p class=\"paywall\">Musselman did not respond to a request for comment.<\/p>\n<p class=\"paywall\">A new age of American conservatism commands the political arena, and more US lawmakers are calling for additional restrictions on adult content. In September, Alabama became the first state to impose a porn tax on adult entertainment companies (10 percent) following the <a data-offer-url=\"https:\/\/legiscan.com\/AL\/text\/HB164\/2024\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/legiscan.com\/AL\/text\/HB164\/2024&quot;}\" href=\"https:\/\/legiscan.com\/AL\/text\/HB164\/2024\" rel=\"nofollow noopener\" target=\"_blank\">passage<\/a> of age-verification mandates, which require users to upload an ID or other personal documentation to verify that they are not a minor before viewing sexually explicit content. Other states have flirted with the idea of a porn tax in the past. So far, 25 US states have passed a form of age verification.<\/p>\n<p class=\"paywall\">Although efforts to criminalize participants in the sex work industry have been ongoing for years\u2014with new regulations unfolding at a moment of heightened online surveillance and censorship\u2014targeted taxes have failed to gain widespread approval because the legality around such laws are up for debate.<\/p>\n<p class=\"paywall\">\u201cThis kind of porn tax is blatantly unconstitutional,\u201d says Evelyn Douek, an associate professor of law at Stanford Law School. \u201cIt singles out a particular type of protected speech for disfavored treatment, purely because the legislature doesn\u2019t like it\u2014that\u2019s exactly what the First Amendment is designed to protect against. <a href=\"https:\/\/www.wired.com\/story\/young-mormons-built-an-app-to-help-men-quit-gooning\/\" target=\"_blank\" rel=\"noopener\">Utah may not like porn,<\/a> but as the Supreme Court <a href=\"https:\/\/www.wired.com\/story\/us-supreme-court-porn-age-verification-decision-2025\/\" target=\"_blank\" rel=\"noopener\">affirmed<\/a> only last year, adults have a fully protected right to access it.\u201d<\/p>\n<p class=\"paywall\">Utah, Alabama, and Pennsylvania are among the <a data-offer-url=\"https:\/\/fightthenewdrug.org\/states-with-porn-public-health-resolutions\/\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/fightthenewdrug.org\/states-with-porn-public-health-resolutions\/&quot;}\" href=\"https:\/\/fightthenewdrug.org\/states-with-porn-public-health-resolutions\/\" rel=\"nofollow noopener\" target=\"_blank\">16 states<\/a> that have adopted resolutions declaring porn a public health crisis. \u201cWe realize this is a bold assertion not everyone will agree on, but it\u2019s the full-fledged truth,\u201d Utah governor Gary Herbert <a data-offer-url=\"https:\/\/x.com\/GovHerbert\/status\/722459209460092928\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/GovHerbert\/status\/722459209460092928&quot;}\" href=\"https:\/\/x.com\/GovHerbert\/status\/722459209460092928\" rel=\"nofollow noopener\" target=\"_blank\">tweeted<\/a> in 2016 after signing the resolution. One of Utah\u2019s earliest statewide responses to the proliferation of adult content happened in 2001, when it became the first state to create an office for sexually explicit issues by hiring an obscenity and pornography complaints ombudsman.
